Jose Cuervo Agave Bar Waiver of Liability Relating to Coronavirus/COVID-19

The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. ​Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death​.

COLLiDE, Proximo Spirits, Inc., ACHE, and their respective equity holders, owners, partners, members, directors, managers, officers, employees, consultants, agents, representatives, successors and/or assigns (collectively, the “Released Parties”), cannot prevent you from becoming exposed to, contracting, or spreading COVID-19 while attending its event and/or entering onto premises where its events are held. It is not possible to prevent the presence of the disease. Therefore, if you choose to attend an event organized by COLLiDE or any of the other Released Parties, and enter into premises where its events are held, you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK​: I have read and understood the above warning concerning COVID-19. ​I hereby choose to accept the risk of contracting COVID-19 for myself in order to attend a COLLiDE event and enter the event premises. I accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to attend in person.

WAIVER OF LAWSUIT/LIABILITY​: I hereby forever release and waive my right to bring suit against the Released Parties for fault in connection with exposure, infection, and/or spread of COVID-19 related to attending its event​. I understand that this waiver means I give up my right to bring any claim based on negligence, including for personal injuries, death, disease or property losses, or any other loss, whether known or unknown, foreseen or unforeseen

THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY AND SAVE AND HOLD HARMLESS COLLiDE, Proximo Spirits, Inc., and ACHE, and their respective equity holders, owners, partners, members, directors, managers, officers, employees, consultants, agents, representatives, successors and/or assigns (collectively, the “Released Parties”) from any loss, liability, damages or costs they may incur, whether caused by the negligence, active or passive, or otherwise while the undersigned is in, upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with The Released Parties.  The undersigned understands and agrees that the Released Parties are not required to provide insurance to cover the undersigned in the event they suffer illness, injury, death, property loss, theft or damage of any sort upon, or about the premises or any facilities or equipment therein or participating in any program affiliated with the Released Parties.

The undersigned agrees and acknowledges that attendance of this event may involve inherent danger and risk, including, without limitation, the risk of physical illness or injury, death or property damage.  THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR, AND RISK OF ILLNESS, BODILY INJURY, DEATH OR PROPERTY DAMAGE to the undersigned due to negligence, active or passive, or otherwise while in, about or upon the premises of Casita Hollywood or events associated with Released Parties.   The undersigned acknowledges that any illness or injuries that the undersigned contract of sustain may be compounded by negligent first aid or emergency response of the Releasees and waive and claim in respect thereof.

THE UNDERSIGNED further expressly agrees that the forgoing ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY, AND INDEMNITY AGREEMENT is intended to be as broad and inclusive as is permitted by the laws of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
